1.1 General Information about Gersh

Gersh is a technology and e-commerce platform that enables users to purchase products from various websites and online stores by inserting the desired product link into the platform. Gersh then completes the purchase process on behalf of the user from the original store, receives the product, ships it, and delivers it to the user.

Payment for the product value and delivery fees is made through the Gersh platform using multiple payment methods, including bank cards or electronic financing companies such as Tamara, or any other approved payment method.

Gersh acts solely as a purchasing intermediary and delivery service and does not represent or maintain any direct commercial relationship with the original store other than executing the purchase on behalf of the user.

You may register on the website through a secure process whereby the Gersh website collects all required information from users before commencing service provision, to activate the account and benefit from our services in an authorized manner. Please follow the instructions and terms below:

  • Please review the following terms carefully and accept them without condition by clicking the “Agree” button below.
  • Register on the Gersh platform using your mobile number or email address. Upon successful registration, you will receive a secret code via SMS to your mobile phone to verify your identity. Do not share the sent secret code.
  • All users of the website are bound by these terms and conditions.

The term “writing” is defined as the content of email messages and/or SMS messages. Synonyms of “writing” or “written” in these terms include the content of email messages and/or SMS messages.

The term “Beneficiary” is defined as the merchant offering its services through the electronic portal of the Gersh website. The term “User” is defined as any person wishing to benefit from the services provided through the electronic portal of the Gersh platform.

  1. Service Definition and Mechanism of Operation

2.1

The user enters the product link from any trusted website, specifying the quantity and delivery address. The user bears full responsibility for entering the correct product link from a trusted and approved website and must specify the required quantity and the full and accurate delivery address when submitting the order.

The platform confirms that its role is limited to executing the order based on the data and information provided by the user. Accordingly, it bears no responsibility for any error resulting from entering an incorrect or inaccurate link or incorrect delivery details, including receiving a product different from the user’s desire due to errors in the link or specifications entered.

2.2

Gersh purchases the product from the original store on behalf of the user using its own details and then handles shipping, receipt, and delivery arrangements.

2.3

The total amount (product price + shipping and delivery fees) is paid through the payment gateway on the Gersh platform.

2.4

Gersh bears no responsibility for product availability, pricing policies, or quality of the original store, and its role is limited solely to completing the purchase and delivery process.

  1. Account Creation and Eligibility

3.1

Usage membership is granted only to users aged 18 years or older. This agreement constitutes a personal, non-transferable, revocable, and terminable license to use the platform under these terms. Any violation of these terms and conditions will result in cancellation of your license.

3.2

The user must provide accurate and up-to-date information, including identity details, payment methods, and address. You may not use misleading or anonymous email addresses, impersonate others, or mislead us or any third party regarding the origin of submitted files. In return, without obligation or direct liability, we may remove or edit any submitted files without notice.

3.3

A personal account is required, and sharing login details with any third party is prohibited. Gersh shall not, under any circumstances, be responsible for any online order that is ambiguous, fraudulent, or executed without the user’s knowledge or consent.

3.4

The user acknowledges full responsibility for any purchases made through their personal account. Using the platform constitutes acknowledgment of understanding these terms. If you do not agree to these terms, you must not use the platform. By clicking “Agree,” you confirm acceptance of these terms and compliance with legal notices, privacy policy, disclaimers, and additional terms displayed on the website.

3.5

You agree to the following account activation terms:

  • Username: The identifier that distinguishes the Gersh platform user. The username is assigned during registration and is unique to each user; currently, it is the mobile phone number and requires access to a smart device to log into the account.
  • Password: A set of symbols chosen by the user during registration, enabling access to the account and platform services. If lost, you may contact customer service or use the electronic portal to reset it.
  • You are fully responsible for protecting your password.
  • Your password is for personal and exclusive use only. Users must observe confidentiality measures to protect other personal identifiers or financial data.

Password requirements:

  • Must include at least one numeric character.
  • Must include at least one uppercase letter.
  • Must be more than 8 characters.
  • Must include one special character (!, @, #, $).

3.6

The beneficiary and/or user fully and unconditionally agrees to the platform’s right to collect, store, and retain all information, data, and documents provided, for use in legally permitted cases.

3.7

Upon suspension or deactivation of your account, you will not be able to benefit from the platform’s services. You acknowledge and agree that account termination does not affect outstanding financial obligations arising from services provided by Gersh.

3.8

If you are dissatisfied with using the platform, you may stop using it at any time without prejudice to any obligations arising from services provided by the platform.

  1. Payments and Financial Dues

4.1

The user must pay the full value of purchased products or services through the electronic payment gateway of the Gersh platform using approved payment methods.

4.2

Accepted payment methods:
The platform provides several payment options, including but not limited to bank cards and electronic financing companies such as mispay and Tamara, or any other payment method approved by the platform in the future.
If the user chooses to pay through an electronic financing company, the user acknowledges and commits to paying installments on time according to the financing company’s terms.

4.3

After successful payment, the platform issues an electronic order number, which serves as the official reference for tracking order status, shipping, returns, and inquiries related to the purchase.

4.4

The user acknowledges that final prices displayed on the platform include the product value, external purchase fees, shipping and delivery fees, and any applicable customs duties or taxes (if any), unless explicitly stated otherwise on the product page or during checkout.

4.5

Gersh reserves the right to modify or recalculate fees in cases of exchange rate changes or differences in shipping, customs duties, or taxes after order execution. The user will be notified of any adjustment before final settlement.

  1. Shipping and Delivery Policy

5.1

Gersh relies on local and international shipping companies to deliver products to users.

5.1.1 Shipping Fee Calculation Criteria

  1. International Shipping
  • Shipping fees are calculated based on the higher of:
    • Actual weight, or
    • Volumetric weight (length × width × height ÷ 5000).
  • No package may exceed 30 kg in weight or dimensions of 110 × 85 × 85 cm.

Local Shipping within Saudi Arabia

  • Calculated based on the higher of actual or volumetric weight using:
    (length × width × height ÷ 4000).
  1. Fees and Taxes
  • All prices are in Saudi Riyals and exclude VAT or other government fees.
  • The user bears responsibility for paying such additional taxes when due.
  • Shipping companies may modify prices with 30 days’ prior notice.
  • Prices are subject to a variable fuel surcharge determined by the sales team.

5.2

Estimated delivery times are sent via the dashboard or email once the order is shipped.

5.3

Delivery duration may vary based on supplier country, user country, customs procedures, or factors beyond Gersh’s control.

5.4

The user must provide a correct and accessible address and be available to receive the order during delivery attempts.

5.5

If delivery fails due to address errors or inability to contact the user, the shipment may be returned to Gersh warehouses, and the user bears re-shipping or return costs.

  1. Returns, Cancellation, and Refund Policy

6.1 Return Policy

Returns of products purchased through Gersh are subject to the return policy of the original store from which the purchase was made, as Gersh acts solely as a technical intermediary.
Acceptance or rejection of return requests depends on the original store’s policy, including return period, product condition, and approved return method, provided the product is unused, in original condition, with full packaging and accessories.

Gersh commits to following up with the original store and providing updates, without assuming financial or legal liability if the store rejects or delays the return.
If approved, the refund is processed through the payment gateway or the same payment method used.

6.1.2

Returning all products constitutes a full return; returning some products constitutes a partial return.

6.1.3

For partial returns, only the returned product value is refunded after deducting shipping, delivery, banking, or other applicable fees.

6.1.4

Non-returnable items (e.g., cosmetics, customized products, or perishable goods) are not accepted.

6.1.5

The user bears all return and shipping costs, including handling, packaging, or restocking fees. If the store rejects the return due to non-compliance or product condition, the user bears all related costs, including two-way shipping.

6.2 Return Request Procedures

6.2.1 The user submits a return request via their account using the order number, stating the reason and attaching product photos.
2 After review and approval, Gersh provides the return address and tracking number.

6.3 Refunds

6.3.1 Refunds are issued only after the original store approves the return and are processed via the same payment gateway using the order number.
2 Refunds are issued to the same payment method; no cash refunds are provided.
3 Refunds appear within 15–30 business days depending on the bank or financing company. Installment plans may be adjusted accordingly.
4 For cash-on-delivery payments, refunds are made via bank transfer after identity verification.
5 The store reserves the right to refuse or partially deduct refunds if the product is damaged, used, or missing accessories.

After purchase, orders cannot be canceled unless approved by the original supplier, and applicable transfer, shipping, or administrative fees may be deducted.

  1. Limitation of Liability

7.1 Product Liability

Gersh bears no responsibility for product quality, specifications, or suitability, as it does not manufacture, store, package, or inspect products. Responsibility lies solely with the user or original seller.

7.2 Scope of Gersh’s Liability

Gersh’s liability is limited to its role as an intermediary platform facilitating purchase, payment, and delivery, without warranties regarding products or after-sales obligations unless explicitly stated.

7.3 Maximum Financial Liability

In all cases, Gersh’s liability shall not exceed the lesser of: (a) the actual product value, or (b) the service fees paid. No liability for indirect or consequential damages.

7.4 Shipping Responsibility

Gersh is not responsible for delays, loss, or damage caused by shipping companies, customs authorities, suppliers, or force majeure events. Responsibility ends upon completion of order and payment on the platform.

  1. Confidentiality and Data Protection

8.1 Confidentiality

Gersh commits to maintaining confidentiality of all user data and shall not disclose it except as required for service execution or by law.

8.2 Data Usage

The user agrees that Gersh may collect and process personal data for:

  • Account management and service delivery.
  • Improving user experience and platform development.
  • Communication regarding orders, offers, or updates.
  • Legal and regulatory compliance.

Data shall not be used for marketing without prior explicit consent.

8.3 Data Storage and Security

Gersh applies technical and administrative measures to protect data, including encryption, secure storage, and restricted access.

8.4 Mandatory Disclosure

Gersh may disclose personal data if required by court order or regulatory authority, or to protect its legal rights or prevent fraud.

8.5 User Rights

Users may request access, modification, deletion of their data, or withdrawal of consent, subject to legal obligations.

8.6 Data Retention

Data is retained as long as necessary for its purposes or legal obligations, then securely deleted or anonymized.

  1. General Provisions

9.1 Governing Law

These terms are governed by the laws of the Kingdom of Saudi Arabia.

9.2 Dispute Resolution

Users are encouraged to contact support. If unresolved within 45 days, disputes shall be referred to competent Saudi courts.

9.3 Third-Party Rights

No third party may benefit from or enforce these terms.

9.4 Relationship of the Parties

Nothing herein creates a partnership, joint venture, agency, or employment relationship.

9.5 Additional Obligations

Each party undertakes to cooperate reasonably to fulfill these terms and legal requirements.

9.6 Assignment

These terms bind the parties and permitted successors. Users may not assign rights without prior written consent.

9.7 Entire Agreement

These terms constitute the entire agreement and supersede prior agreements.

9.8 Amendments

Gersh reserves the right to amend these terms. Continued use constitutes acceptance.

9.9 Severability

Invalid provisions shall be severed without affecting remaining provisions.

9.9 Force Majeure

Neither party is liable for failure due to events beyond control.

9.10 No Waiver

No waiver constitutes a continuing waiver unless in writing.

9.11 Survival

Provisions that by nature survive termination shall remain in effect.
